Welcome. These Terms and Conditions (“Terms”) govern your access to and use of hawaiivacationhomes.com (the “Site”) and the services offered by Hawaii Equity Management LLC (“we,” “us,” or “our”). By accessing the Site, submitting an inquiry, requesting a revenue estimate, or booking a property, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

Please read these Terms carefully before proceeding.

1. Who We Are

This Site is owned and operated by Hawaii Equity Management LLC, a licensed Hawaii real estate brokerage (License #RB-23767). All real estate and property management services are provided through Hawaii Equity Management LLC.

2. Eligibility

You must be at least 18 years old to use the Site. To book a property, guests must be at least 21 years old and may be required to present valid government-issued identification before or at check-in.

3. Use of the Site

You agree to use the Site only for lawful purposes. Prohibited conduct includes, without limitation:

• Attempting to breach, disable, or compromise the security of the Site;
• Transmitting spam, unsolicited messages, malware, or harmful code;
• Scraping, copying, duplicating, or misusing content or data from the Site; and
• Using the Site in any way that infringes the rights of others or violates applicable law.

All content on the Site, including text, graphics, logos, and images, is the property of Hawaii Equity Management LLC or its licensors and is protected by intellectual property laws. You may not reproduce or redistribute it without our prior written permission.

4. Property Management & Revenue Estimates (Property Owners)

If you request a free revenue estimate or property management services, you authorize us to contact you regarding your request using the contact information you provide. Revenue estimates are illustrative projections based on available market data and are not guarantees of future performance. Any property management relationship is governed by a separate written management agreement between you and Hawaii Equity Management LLC; these Terms do not create a management agreement or agency relationship on their own.

5. Booking Terms (Guests)

Properties may be reserved directly through the Site or via third-party platforms. The booking process and applicable terms vary by platform.

• Identification: valid government-issued ID may be required before or at check-in.
• Payments: a deposit or full payment is typically required at the time of booking. Specific payment terms are provided prior to confirmation.
• Taxes and fees: applicable taxes and fees, including Hawaii General Excise Tax (GET) and Transient Accommodations Tax (TAT), along with any cleaning, resort, or service fees, will be disclosed during the booking process and are the responsibility of the guest.
• House rules: acceptance of each property’s house rules is required, including any policies on noise, occupancy, check-in/out times, and amenity use.

Failure to comply with booking terms may result in cancellation without refund.

6. Cancellations & Refunds

The cancellation and refund policy applicable to your reservation is presented during the booking process. Typical direct-booking policies include:

• Full refund for cancellations made more than 30 days before arrival;
• Partial refund for cancellations made 14–30 days before arrival; and
• No refund for cancellations made within 14 days of arrival.

If you book through a third-party platform (such as Airbnb or Vrbo), that platform’s cancellation and refund policies apply and may differ from those above.

7. Guest Responsibilities

Guests agree to treat the property and surrounding area with care and respect, and specifically agree to:

• Follow house rules as posted or communicated;
• Observe occupancy limits — only the number of guests stated in the reservation may stay overnight;
• Avoid unauthorized gatherings — parties or events are prohibited unless expressly approved;
• Accept responsibility for damage — guests are financially responsible for damage, excessive cleaning, or lost items caused during their stay; and
• Respect pet and smoking policies — unless expressly permitted, pets and smoking are not allowed on the premises.

Violations may result in eviction without refund and charges for damage or additional cleaning.

8. Assumption of Risk

Vacation properties and their surroundings may include pools, hot tubs, beaches, ocean access, stairs, and other features and recreational activities that carry inherent risks. Guests and their invitees use these features and engage in any activities at their own risk and are responsible for their own safety and the safety of any minors or guests in their party. We do not provide lifeguard, supervision, or safety monitoring services.

9. Listings & Accuracy

We strive to keep property descriptions, photos, availability, and pricing accurate, but we do not warrant that all information is error-free or current. Rates, availability, fees, and property details are subject to change until a reservation is confirmed. We reserve the right to correct errors and to cancel or refuse any reservation affected by a material error.

10. SMS / Text Messaging Terms

By providing your mobile number and opting in through a checkbox on our website forms, you consent to receive text messages from Hawaii Equity Management LLC.

• Program: Messages relate to your revenue estimate request, property management services, scheduling and follow-up, and, for guests, booking and stay-related communications.
• Frequency: Message frequency varies based on your interaction with us.
• Cost: Message and data rates may apply.
• Opt-out: Reply STOP at any time to unsubscribe; you will receive a confirmation and no further messages.

• Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: See our Privacy Policy for how we handle your information. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

Consent to receive text messages is not a condition of purchasing any property, booking, or service.

11. Third-Party Platforms

Bookings or referrals made through third-party platforms (such as Airbnb or Vrbo) are subject to those platforms’ separate terms, policies, and fees, in addition to these Terms. We are not responsible for the acts, omissions, or policies of third-party platforms.

12. Disclaimers

The Site and our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Hawaii Equity Management LLC and its members, managers, employees, agents, and partners will not be liable for:

• Website issues: temporary unavailability, inaccuracies, or technical errors;
• Guest incidents: injuries, accidents, illness, losses, or thefts occurring before, during, or after a stay; or
• Force majeure: delays, cancellations, or failures caused by natural disasters, severe weather, strikes, governmental actions, utility or internet outages, or other events beyond our reasonable control.

In no event will our total liability arising out of or relating to these Terms or your use of the Site or services exceed the amount you paid to us for the reservation or service giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Guests are strongly encouraged to obtain appropriate travel and medical insurance prior to their stay.

14. Indemnification

You agree to indemnify and hold harmless Hawaii Equity Management LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or services, your stay at a property, or your violation of these Terms or applicable law.

15. Privacy

Your use of the Site and our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it to understand our practices.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site or services will be brought exclusively in the state or federal courts located in Maui County, Hawaii, and you consent to the jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last Updated” date. It is your responsibility to review this page periodically. Your continued use of the Site or services after changes are posted constitutes acceptance of the revised Terms.

18. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any separate written agreement you enter into with us (such as a property management agreement), constitute the entire agreement between you and us regarding the Site and our services.
